Clark, Director of ommunity <br /> Development, hereby requests amendment to Section XXI. of the <br /> Zoning Ordinance (Ordinance #3512 ) relative to special use <br /> regulations . More specifically, petitioner requests that <br /> Sections XXI.A. 1. and XXI.A.3 . be amended to read as follows <br /> respectively: <br /> XXI.A.1. <br /> The City Council by an aff irmative two-thirds vote may by <br /> Ordinance grant a special use permit only for the following <br /> special uses in any district, except as herein qualified, from <br /> which they are otherwise prohibited by this Ordinance, and may <br /> vary the application of otherwise applicable regulations for such <br /> special uses , provided that the essential character and nature of <br /> the surrounding neighborhood are not disturbed, and may also <br /> impose appropriate conditions and safeguards , including a <br /> specified period of time for the permit, to protect the <br /> comprehensive plan and to conserve and protect property and <br /> property values in the neighborhood. <br /> XXI .A.3 . <br /> Except as specifically provided otherwise by the City Council, <br /> any special use shall comply with all the regulations set forth <br /> in this Ordinance for the district in which such use is located. <br /> The purpose of the proposed amendments is to give the City <br /> Council the authority to vary specific provisions of the Zoning <br /> Ordinance (yard setbacks , off street parking, lot area, etc. ) as <br /> they may deem necessary and appropriate when considering and <br /> taking action on requests for special use permits . In accordance <br /> with existing regulations , all land uses approved by means of a <br /> special use permit must comply with the regulations of the <br /> respective zoning classification, except as may be specifically <br /> noted under each use category. <br /> Staff is of the opinion that the proposed amendments as <br /> submitted will provide for a necessary latitude of review by the <br /> City Council to vary from precise regulations of the Zoning <br /> Ordinance regarding special use permits while keeping with the <br /> intent and character of a specif ic development or neighborhood. <br /> Resp full submitted, <br /> .
