4 � Y� r � t deficiency, in which event the Project will be completed in accordance with the plans and specifications therefor . 8 . If in the judgment of the Commis- sion, practical considerations during the period of acquiring the Project require minor changes in the plans and specifications, the Commission may make such changes without con- sulting the City or the County. If the Commission determines to make major changes in the plans and specifications, the Commis- sion shall consult with the City and the County concerning such changes, provided, however, that after consultation the Commis- sion shall have the sole right to determine whether or not to make such changes without the consent of the City or the County. 9 . The Commission will use its best efforts to complete the acquisition of the site and construction of the Project at the earliest possible date; failure, however, to complete the acquisition of Project shall not relieve the City or the County of their obli- gation to pay the fixed annual rentals provided for herein. C. The rentals set forth herein shall include amounts to cover Maintenance and Operation Expenses (as defined in the Bond Resolution) of the Project 'which shall be deemed to include, but not to the exclusion of other items not herein specified, elevator service, lights, water, electricity, heat, air conditioning, janitor , caretaking and custodial services, and repairs to the interior or exterior, whether structural or ' nonstructural. The Commission, the City and the County agree I that the Commission will provide for the Maintenance and Operation Expenses of the Project but that the Commission is under no obligation to pay the costs of such operation and maintenance except from such rentals or other funds provided to -6-
