NOW , THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE <br /> CITY OF DECATUR , ILL,I �!OIS : <br /> DEFINITIONS <br /> Section 1 . The following words and terms as used in <br /> th � s Ordinance shall have the followjng mean� ng unless the context <br /> or use indicates another or different meaning or intent : <br /> "Agreement" means the Loan Agreement , dated as of <br /> December 1 , 1982 , by and between the Issuer and the Company , as <br /> from time to time amended and supplemented . <br /> "Bond Purchase Agreement" means the Bond Purchase <br /> Agreement dated as of December 1 , 1982 , between the Issuer and <br /> the Purchaser . <br /> "Bonds " means the bonds authorized to be issued hereunder. <br /> "Company" means Burks Pumps , Inc . , a Delaware corporation . <br /> " Indenture" means the Trust Indenture , dated as of <br /> December 1 , 1982 , by and between the Issuer and the Trustee. <br /> " Issuer" means the City of Decatur , Illinois and � ts <br /> successors and assigns . <br /> "Letter of Credit" means the Irrevocable Letter of <br /> C�edit issued by Irving Trust Company , New York , New York , <br /> to the Trustee for the benefit of the owners of the Bonds . <br /> "Note" means the Series I982 Note provided for in the <br /> Agreement whereby the Company promises to make installment payments <br /> on the Note in satisfaction of the Company ' s debt to the Issuer <br /> under the Agreement . <br /> -3- <br />
