•, (, ��iCRQFILMED ORDINANCE NO. � a _ c�� ORDINANCE APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING LAND ACQUISITION EAST CHANNEL DRAINAGE IMPROVEMENT CITY PROJECT 7812 WHEREAS, certain lands in and of the City in the area in the northeasterly portion thereof heretofore identified and designated as surface water drainage area 15 are subject to recurrent flooding by surface waters and to the consequent damage and threat to the public health, aafety and welfare connected therewith; and, WHEREAS , in furtherance of the continued and on�-going program of the City to construct a system of channels and drains to alleviate such flooding, damage and threat to the public health, safety and welfare throughout the City, plans and specifications have been prepared for that portion of said program commonly known as the East Channel Drainage Improvement, which plans and specifications have been subma.tted herewith to and are now before the Council; and, WfHEREAS, it is necessary that certain lands and r�,ghts �n lands be acquired to construct said improvement and the appur- tenance thereto, either by voluntary agreement or by the exercise of the power of eminent domain as provided by law. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the plans and specifications for the East Channel Drainage Improvement submitted to and now before the Council be, and the same are hereby, approved and said Project be, and it is hereby, designated Storm Water Drainage Facility Project 76-77, Construction Project 15-31, City Project 781,2 , the same being dated June of 1982 and prepared by Dennis E . Roby & Associates, along with Blank, Wesselink, Cook & Associates, Inc. and Horner and Shifrin, Inc. , Section 2. That it be and it is hereby determined to be I, necessary and desirable that the City, in order to carry out ! and construct said surfaee water drainage public improvement, � acquire title to or rights in real property situated in the City ' and described in each of the descriptions attached hereto and I hereby made a part hereof as if fully set out herein. �! Section 3. That it be, and it is hereby determined that I the aforesaid real property and the acquisition thereof is � necessary for a public use and purpose.
