�, , ,� �I{CROFlLMEU <br /> ORDINANCE NO. �--� � <br /> ORDINANCE VACATING ALLEY <br /> - FORESIGHT, INC. - <br /> WHEREAS , the alley in Block 15 of the Extension of Allen, <br /> McReynolds and Co`s Addition and extending from former Jackson <br /> Street to North Broadway Street between East Prairie and East <br /> Main Streets, was by the Council in February, 1967 vacated, <br /> except for the East 127 feet thereof, all at the request in <br /> petition of Foresight, Inc. , the owner of all premises abutting <br /> each side of the �acated portion of said alley; and, <br /> WHEREAS, al.though it was apparently intended that all the <br /> portion of said alley upon which the premises of said company <br /> abutted be vacated, in fact such vacation failed twenty (20) <br /> feet short of encompassing all the portion of said alley so <br /> situated; and, <br /> WHEREAS, Foresight, Inc. now intends to improve the <br /> westerly portion of Lot I2 in said B1ock 15 with a hard surface <br /> motor vehicle parking lot for the customers of its tenant, <br /> Sears, Roebuck & Co. and in connection therewith has petitioned <br /> that an additional twenty (20} feet of said alley be vacated so <br /> that the newly improved parking area may be uniformly tied into <br /> the existing improved parking area to the north thereaf; and, <br /> WHEREAS, the public interest wi11 be subserved by vacating <br /> said portion of said alley and the public will be relieved from <br /> the fnrther burden and responszbility of maintaining the same <br /> and no property will be daTnaged by the vacation or closing thereof; <br /> and, <br /> i�HEREAS, the Council finds that the benefit accruing to the <br /> abutting property owner by reason of said vacation will be equal <br /> in amount to the benefit accruing to the public by reason of said <br /> proposed improvement; and, <br /> W�HEREAS, said portion of said alley is no longer usefu]. to <br /> the public or to the City or to the owners of propertg abutting <br /> thereon as an alley, said portion being described as : <br /> Commencing on the North Iine of Lot 12 in Block 15 <br /> of the Extension of Allen, McReynolds and Co' s <br /> Addition to Decatur, as per Plat recorded in Book <br /> G page 365 of the records in the Recorder' s Office <br /> of Macon County, Illinois, at a point 107 feet West <br /> of the Northeast corner of said Lot, thence North <br /> 16 feet to the South line of Lot 13 in said Block 15 , <br /> thence West along said South line twenty (20) feet, <br /> thence South 16 feet to the North line of said Lot 12 , <br /> thence East twenty (20) feet to the place of beginning.
