. � <br /> . <br /> EXHIBIT A <br /> 39 . (a) A police officer may remove or cause to be <br /> removed a vehicle as authorized herein only after notice that <br /> such vehicle may be removed and that the owner of such vehicle <br /> is entitled to a hearing thereon is given to the registered <br /> owner thereof, except as provided in subparagraph (b) hereof . <br /> If such vehicle is not praperly registered or properly displaying <br /> license plates so as to permit the owner' s name to be ascertained, <br /> the police officer shall affix such notice to said car. If the <br /> owner of such vehicle does not appear for a hearing as provided <br /> by said notice, such vehicle may be removed, but not sooner than <br /> 7 days after such notice is given. If the owner of such vehicle <br /> does appear as provided, such vehicle may be removed immediately I <br /> upon notification to the owner that probable cause exists to �I <br /> believe that the violation occurred as alleged. <br /> (b) A police officer may remove or cause to be removed <br /> a vehicle as authorized herein without notice to the owner thereof <br /> whenever such vehicle is parked or abandoned so as to constitute <br /> an immediate hazard or obstruction to other vehicles on or seeking <br /> access to public streets, provided that notice as required in <br /> subparagraph (a) hereof is given to such owner, if the same can <br /> be ascertained, within 24 hours of such removal.
