, • +• w ��„V��ll,^_ � � . ` ORDIIIANCE N0. a — 3 � AN ORDINANCE GRANTING SPECIAL PERMIT R-5 RESIDENCE DEVELOPMENT PLAN REGENCY PLACE WHEREAS , on the 4th day of March, 1982 , upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Richard D. Cain and others for a special permit under the provisions of Section XXI (c) for an R-5 Residence Development Plan on premises situated in the City of Decatur, Illinois , and described as set out on Exhibit A attached here- to and hereby made a part hereof; and, WHEREAS , said Decatur City Plan Commission recommended that such Residence Development Plan be approved. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF TciE CITY OF DECATUR, ILLINOIS : Section l. That the recommendation and report of the Decatur City Plan Commission be, and the same are hereby, re- ceived, placed on file and approved. Section 2 . That upon the conditions hereinafter men- tioned, a special permit be, and it is hereby, granted Richard D. Cain, James C. Ielase , Ronald K. T1cGre�or and Douglas W. Polite, Jr. to develop the premises aforesaid under an R-5 Residence Development Plan in accordance with the plat and plan thereof hereto attached, marked Exhibit B , and hereby made a part hereof. Section 3 . That said special permit authorized hereby be , and the same is hereby, expressly conditioned as follows : (a) That before applying for a buildin; per- mit applicable to said prer.iises , and before com- mencing any construction or any improvement on said premises , petitioners cause to be prepared de- tailed plans and specifications including design data for sanitary sewers , watermains , surface water drainage and drains , streets , sidewalks , driveways , , parking lots , entrances , fire hydrants and utilities and submit the same to and obtain the approval in writing of the Director of Public Works and the
