80-22 VACATING A PORTION OF STREET NORTH WOODFORD STREET

, ., NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1 . That the above described portion of said street be, and the same is hereby, vacated as a public street effective and upon the exceptions and conditions hereinafter provided, inasmuch as the same is no longer required for publuc use and the public interest will be subserved by such vacation, said portion of said street being shown on the plat thereof hereto attached and hereby made a part hereof. Section 2. That there is hereby reserved in, over, along and under the above described portion of said street, to th� City of Decatur, Illinois, and to the public and to those utilities and companies as the case may be owning public service facilities , mains, sewers, telephone and electrical or other public utilities, such prope�ty, rights-of-way and easements as are or may be necessary or desirable for continuing public service by means of such facilities and for the maintenance, renewal, and reconstruction thereof with the right of ingress and egress for such purposes. Section 3. That the benefits which will accrue to the owners of abutting pro.perty by reason of the vacation aforesaid is determined to be, in the judgment of the Council, equal to the sum of Four Thousand Seven Hundred Fifty Doll�rs ($4 , 750 .00) . Section 4 . That the vacation herein provided for is made upon the express condition that there shall be paid to the City of Decatur, Illinois, by, or on behalf of the owners of all property abutting upon that portion of said street vacated hereby the sum of $4 , 750 .00 as compensation for the benefits determined as above set out herein, upon the payment whereof such vacation shall become effective.
