� � � �� � � ' ���� ��� <br /> �� <br /> ORDINANCE N0. � I <br /> ORDINANCE AMENDING R-6 RESIDENCE DEVELOPMENT PLAN <br /> - SHOREWOOD ESTATES - <br /> WHEREAS, on the 5th day of April, 1979 , upon due notice, the <br /> Decatur City Plan Commission held a public hearing upon the petition <br /> of Z . J. Inc. to modify and amend the provisions of the R-6 Residence <br /> Development Plan approved by Ordinance No. 7196 in so far as said <br /> provisions apply to a portion of said Residence Development Plan, <br /> said portion being more particularly described on Exhibit A attached <br /> hereto and hereby made a part hereof; and, <br /> WHEREAS , said Decatur City Plan Commission did report its <br /> findings and did recommend that the amendment and modification of <br /> said R-6 Residence Development Plan as requested be authorized. <br /> , <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS : <br /> Section l . That the report and recommendation of the Decatur <br /> City Plan Commission be, and the same is hereby, received, placed <br /> on file and approved. <br /> Section 2. That subject to the conditions hereinafter mentioned, <br /> said Residence Development Plan be, and the same is hereby, amended <br /> and modified and petitioner be, and hereby is , authorized to develop <br /> the premises above described in accordance with the plot plan <br /> thereof hereto attached, marked Exhibit B, and hereby made a part <br /> hereof. <br /> Section 3 . That said amendment and authorization be, and the <br /> same are hereby, expressly conditioned as follows : <br /> (a) That the common area indicated on Exhibit B as lying <br /> directly north of Lot 6 of Phase I, and those streets marked <br /> as private drives in said Phase I , be owned and maintained by <br /> a home owner' s association set up in perpetual corporate form <br /> , and consisting of the owners of all lots shown in Phase I of <br /> Exhibit B. <br /> (b) That all watermains , sanitary sewers and storm sec�zers on <br /> said premises be constructed according to the Construction Standards <br /> of the City of Decatur, and that all such watermains and sanitary <br /> sewers be dedicated to the City of Decatur along with easements <br /> therefor. <br /> .;- <br />
