� . • , - . <br /> LEGAL DEPARTMENT MEMORANDUM <br /> N0. 78-153 <br /> November 8 , 1978 <br /> T0: City Manager <br /> FROM: Corporation Counsel <br /> Transmitted here with is a copy of an appropriate ordinance <br /> to vacate portions of Hill Park Avenue and Hill Park Drive <br /> along with a plat and an appraisal report. <br /> This vacation has been recommended by the Plan Commission <br /> and has in effect been previously approved by the Council when <br /> it approved the Residence Development Plan for Lots 12 , 13 and 14 <br /> of Hill Park Addition. , <br /> You will note that the ordinance fixes compensation at <br /> $6 , 830 which is more than the $5 , 370 set out in the appraisal <br /> report. This is because the appraiser used the figure 21, 480 <br /> for the square footage of the vacation when in fact the correct <br /> figure is 27, 320 square feet. The owners of Lots 12 , 13 and 14 <br /> are the petitioners. There is also transmitted herewith a copy <br /> of a statemen t from the owners of lot 11 that they have no <br /> objection to the vacation. <br />
