The Il�inois Department of Transportation <br /> • and the Federal Insurance Adsainistration shall be notified prior to <br /> any alteration or relocation of a watercourse. Tne flood carrying <br /> capacity within said altered or relocated portion shall be maintained. <br /> Section 13 . Variances . Upon app�ication, after public hearing, <br /> no�ice of which is pui�lished not less than 15 days prior thereto, and <br /> subject to, and complying with, the applicable provisions of the <br /> rules and regulations of the National Flood Insurance Program the <br /> Council may vary the application of the provisions hereof attaching such <br /> conditions thereto as it deems necessary to carry out the intent <br /> of this ordinance. <br /> Section 14 . Re�orts and Records. The Building Official is <br /> authorized to provide to the Illinois Department of Transportation <br /> and t�e Federal Insurance Administration and to the Council an annual <br /> report as prescribed by said Administration and said officer is <br /> designated the keeper of those records required under said Program to <br /> be kept by the City. <br /> Sectian 15 . Liability. The degree of fl�od protection ordained <br /> hereunder is considered reasonable for regulatory purposes only. <br /> Alth�ugh based on engineering and scientific methods of study it is <br /> intended for the benefit and protection of the public health, safety <br /> and welfare generally and not for the benefit or protection of any <br /> individual member thereof. Floods in size or height above or beyond <br /> the criteria established hereby may occur from time to time. Nothing <br /> in this ordinance imp.lies or provides, or shall be construed to <br /> imply or provide, that any development whether within or without <br /> a Zone A is or will be free from flooding or damages . This ordinance , <br /> does not create and is not intended to create and shall not be ! <br /> construed to create liability on the part of the City or any officer i <br /> or employee thereof for any damages resulting from, connected <br /> with or growing out of reliance upon any provisions thereof or any <br /> decision made hereunder. <br /> Section 16 . Violation. Any person, firm or corporation that <br /> violates a provisions hereof shall upon conviction be fined not to <br /> exceed $500 . 00 . A separate offenae shall be deemed committed <br /> upon each day during or on which a violation occurs or continues . <br /> In addition thereto , or in lieu thereof, the provisions hereof may <br /> be enforced by appropriate civil remedy including injunction <br /> or abatement of nuisance. <br /> Section 17 . Severability. The provisions hereof are separable <br /> and the invalidity of any portion shall not affect the validity of <br /> the remainder . <br /> Section 18 . Other Regulations . The provisions hereof are <br /> cumulative of and in additionin other provisions of law, ordinance , <br /> standard, code , rule or regulation applicable withir. the City. To <br /> the extent the same may conflict with the provisions hereof, said other <br /> provisions of ordinance, standard, code , rule or regulation are hereby <br /> modified to accord and comport with the provisions hereof, except that <br /> if application of such other provision would better enhance the <br />
