i `.~ ' �• <br /> . � � � MICROpiLM� <br /> ORDINANCE N0. �lD <br /> ORDINPNCE GF.ANTING CONDITIONAL AND <br /> LIMITED VARIANCE OF MINIMUM PARKING <br /> SPACE REGULATIONS <br /> WHEREAS, Thomas B. Rosenberg and Fred H. Loeb, d/b/a Willow <br /> Heights Associates, are the owners of the followng described <br /> property located in the City of Decatur, Illinois : <br /> Lot 10 of A-D-G Specialty Center as per plat recorded <br /> in Book 1575 page 247 of the records in the Recorder' s <br /> Office of Macon County, Illinois , <br /> and said partnership proposes to construct thereon certain improvements <br /> to be used as housing for elderly persons of low income; and, <br /> WHEREAS, said partnership has requested that the parking and <br /> loading regulations of the City be varied by reducing the minimum <br /> number of required mo tor vehicle parking spaces to be constructed <br /> and maintaine� on said site appurtenant to said use to three- <br /> fourths that number which would otherwise be required by said regulations <br /> in the R-6 Mutiple Family District; and, _ <br /> WHEREAS , said partnership has represented and agreed that any <br /> such variance may be limited and conditioned and said limitations <br /> and conditions may be made a matter of record and a restriction upon <br /> and in the title of said premi.ses for the benefit of the health, <br /> safety and welfarz of the community to, among other things enhance <br /> the quiet, peace and repose of the neighborhood of said premises and <br /> lessen or prevent the congestion of motor vehicles upon its streets , <br /> and that the same may be enforeed by the City in its own name by any <br /> appropriate action including injunction; and, <br /> WHEREAS , after notice as provided by law and ordinance, the <br /> Zoning Board of Appeals on April 13, 1978 , held a public hearing <br /> upon such request and did report and recommend that the same be granted <br /> and said regulations be varied as so limited and conditioned. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section l. That the report and recommendation of the Decatur <br /> Zoning Board of Appeals be, and the same is hereby, received, placed <br />
