� <br /> � � <br /> . � <br /> ` � s <br /> a <br /> 4 �� ORDINANCE NO. � /3 9 <br /> ,�ICROFILMEO <br /> .�_ <br /> AN ORDINANCE GRANTING SPECIAL PERMIT <br /> R-3 RESIDENCE DEVELOPMENT PLAN <br /> WHEREAS, on the 4th day of August, 1977, upon due notice, <br /> the Decatur City Plan Commission held a public hearing upon the <br /> petition of Gerhard Florian and Roger L. Grohne for a special <br /> permit under the provision of Section XXI C of Ordinance No. 3512 <br /> of the City of Decatur, as amended, the same being the Zoning <br /> Ordinance, for an R-3 Residence Development on premises situated _ <br /> in the City of Decatur, Illinois, and described as : <br /> That part of the Northeast Quarter of the Southeast <br /> Quarter of Section Seven, Township 16 North, Range 2 <br /> East of the Third Principal Meridian lying North <br /> of the North right-of-way line of the Norfolk and <br /> Western Railroad, situated in Decatur Township, <br /> Macon County, illinois; <br /> and, <br /> WHEREAS, said Decatur City Plan Commission recommended that <br /> such Residence Development Plan be approved. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUI2, ILLINOIS : <br /> 5'ection l. That the recommendations and report of the <br /> Decatur City Plan Commission be, and the same are hereby, received, <br /> placed on file and approved. <br /> 5ection 2. That upon the conditions hereinafter mentioned, a special <br /> permit be, and it is hereby, granted Gerhard Florian and Roger L. <br /> Grohne to develop the premises aforesaid under an R-3 Residence <br /> Development Plan in accordance with the plat marked Richland Heights <br /> Residence Development Plan prepared by Shaffer Krimmel Silver, said <br /> plat being attached hereto and hereby made a part hereof and being <br /> marked Exhibit 1. <br /> Section 3. That said special permit authorized hereby be, <br /> and the same is herehy, expressly conditioned as follows : <br /> (a) That said premises be developed in accordance with the plat <br /> aforesaid and only in accordance with said plat for residential and <br /> incidental use as shown therein, and none other, and that alI <br /> driveways, accessways, entrances, walkways, parking lots, buildings, <br /> sight break screens, landscaping, tences, recreational facilities, <br /> yards, open space, streets, sidewalks, curb and gutter, setbacks, <br /> public utilities and all other structures and improvements be <br /> constructed, provided, furnished and improved as shown and as located <br /> on said plat. <br />
