LEGAL DEPARTMENT MEMORANDUM <br /> NO. 77-57 <br /> MEMO TO: CITY MANAGER <br /> FROM: � CORPORATION COUNSEL <br /> IN RE: Utility Easements <br /> Alley in Block 12 <br /> Pythian Home Addition <br /> The First National Bank of Decatur is in the process of <br /> developing a satellite facility on the north side of <br /> McKinley between Main and Water. <br /> The premises are bisected by utility easements reserved <br /> when the alley itself was vacated by Ordinance No. 3166, <br /> passed June 28, 1958. <br /> At the expense of the bank all existing utilities have <br /> been relocated away from the reserved easements to other <br /> c::isting nearby available easements; except for sanitary <br /> sewer. This sewer will not materially interfere with use <br /> of the surface by the bank, or will such surface use mat- <br /> erially interfere with the operation and maintenance of the <br /> sewer. The bank requests release and vacation of utility <br /> easements except the sewer. <br /> We have been furnished with waivers and consents for the <br /> requested action from Illinois Power, Illinois Bell and <br /> G. E. Cablevision. Memos from the Water, Public Works <br /> and Community Development Departments concur with the bank' s <br /> request. <br /> Transmitted herewith is a suggested ordinance for Council <br /> consideration appropriate to accomplish such action. <br />
