ORDINANCE NO. 77-64 �d JUN - 61977 ORDINANCE RELEASING AND VACATING Reoorded In Book �918 Paga� RESERVED EASEMENTS-PYTHIAN HOi�IE ADDITION �""""_ j/ �f ' R""� 8'"� MICR �Q �gR��of� WHEREAS , by Ordinance No. 3166, passed and approved June 30 , 1958 , the Council vacated a certain alley therein described in Block 12 of Pythian Home Addition, and in and by said ordinance reserved easements for sewer and other public utilities then existing in said alley at the time of vacation; and, �aHEREAS, alI said public utilities, at the expense of the current owner of all land abutting said alley, have been relocated away therefrom with the exception of said sewer; and, WHEREAS, said owner has requested that said reserved ease- ments , excepting the easement for sewer, be released and vacated and has fu�nished evidence from the concerned public utility companies of their consent thereto and concurrence therein. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section l. That trose easements for public utility purposes heretofore reserved by Ordinance No. 3166 , in the alley in Block 12 of Pythian Home Addition therein described be, and the same are hereby, released and vacated except for the easement for sewer therein so reserved. Section 2 . That said easement for sewer be, and the same is hereby, continued to be reserved and continued to be excepted from the vacation of said alley by said ordinance and of the release and vacation of the other easements by this ordinance, and thereby continue in full force and effect.
