MYERS - <br /> WHEREAS, on the 3rd day of February, 1977, the Decatur City Plan <br /> Commission, after notice as required, held a public hearing upon the <br /> petition of DONALD G. MYERS for a special use permit to construct and <br /> operate an R-3 RESIDENCE DEVELOPMENT PLAN on premises in the City of <br /> Decatur, Illinois, described as : <br /> A part of the Northeast Quarter of the Northeast Quarter of <br /> Section 35 , Township 17 North, Range 2 East of the 3rd P.M. , <br /> described as : Beginning at a point on the East line of the <br /> Northeast Quarter of the Northeast Quarter of said Section <br /> 35, 974. 88 feet South of the Northeast corner; thence South <br /> 350. 0 feet to the Southeast corner of the Northeast Quarter <br /> of the Northeast Quarter; thence West 1315. 6 feet to the <br /> Southwest corner; thence North 1264 . 0 feet to a point on the <br /> South right-of-way line of East Mound Road; thence East 350 . 0 <br /> feet; thence South 964 . 88 feet; thence East 965. 17 feet to the <br /> point of beginning; <br /> situated in the County of Macon and State of Illinois; and, <br /> WHEREAS, said Decatur City Plan Commission recommended that such <br /> residence plan be approved and said special permit issued. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS : <br /> Section l. That upon the conditions hereinafter mentioned, a <br /> special permit be, and it is hereby, granted DONALD G. MYERS to <br /> develop the premises aforesaid by constructing and operating thereon <br /> an R-3 RESIDENCE DEVELOPMENT PLAN in accordance with the plot plan <br /> thereof hereto attached and hereby made a part hereof as if fully set <br /> forth herein, said plot plan being designated Primrose Estates and <br /> being labeled Sheet #A3, a Warren E. Hagan Consulting Engineer Project <br /> No. 1759 , with last revision of March 3, 1977 . <br /> Section 2 . That said special permit ordai,ned and grant hereby <br /> be, and the same is hereby, expressly conditioned as follows : <br /> (a) That said premises be developed in accordance with <br /> the plot plan aforesaid and only in accordance with said plot plan <br /> for residential and incidental use. as shown therein and none other <br /> and that all driveways, access-ways, entrances , walkways , parking <br /> lots , buildings, site break screens , landscaping, fences , recreational <br /> facilities , yards, open space, streets , sidewalks , curb and gutter, <br /> set backs , public utilities and all other structures and improvements <br /> be constructed, provided, furnished and improved as shown and as <br /> located on said plot plan. <br />
