Chapter. 35 <br /> . , <br /> The period of time allowed for closing an opening will <br /> be governed by the size and nature of the opening. If the work <br /> is not started and completed within the time designated on the <br /> permit, the permit will be cancelled and a cancellation charge <br /> of Two Dollars ($2. 00) will be made. <br /> After work is started it shall be continuous until the <br /> opening is backfilled and the surface restored as provided in <br /> this chapter. If in the opinion of the City Engineer the per- <br /> mittee is not following regulations , permits for future openings <br /> will not be issued. <br /> Openings made where new streets or pavements are being con- <br /> structed will be inspected by the City Engineer and must meet <br /> all requirements of the specifications for excavating and back- <br /> filling as stated in the contract or contracts for new street <br /> construction. A permit will not be issued for openings in new <br /> pavements for a period of three (3) years af ter the date of <br /> completion, except in emergencies due to leaking or broken water, <br /> gas , or sewer lines, or in case of undue hardship to a property <br /> owner. New pavements may be opened only on written authority <br /> from the City Manager. <br /> Except in cases of emergency, permits must be obtained be- <br /> fore the street opening is made. I{ an opening is made without <br /> a permit, due to an emergency, the permit must be applied for <br /> on the first workday following the date of the opening. <br /> 4 . Restoration of pavement or payment of the cost thereof Deposit or <br /> must be assured in one of the following ways : Security <br /> for Pay- <br /> (a) The applicant has made a cash deposit eqtzal to tbe�esti- ment <br /> mated charge for restoration at schedule prices. Restoratior <br /> (b) The applicant has opened a running account by making <br /> an initial deposit suitable to the City, to be replenished by <br /> the applicant voluntarily or upon request by the City. No per- <br /> mit shall be issued under this provision unless there is an <br /> unencumbered amount in the applicant' s account sufficient to <br /> cover the estimated restoration charge on permit applied for. <br /> (c) The applicant is a corporation whose franchise empowers <br /> it to make its own paving restoration, but such permits will be <br /> issued only when the restoration work keeps fully apace with the <br /> openings being made . Such corporations shall pay promptly all <br /> bills for inspection at scheduled rates , and all bills for re- <br /> storation done by City forces. <br /> (Amended by Ord. 77-20 , February 7 , 1977) <br /> If at any time during the course of the work it appears that <br /> the cash on deposit is inadequate to cover the cost of restoration, <br /> an additional sum shall be deposited by the permittee in an amoun- <br /> equal to the difference between the deposit and the revised esti- <br /> mate of charge. <br />
