. <br /> Chapter 35 , <br /> STREET EXCAVATIONS <br /> 1. No person, firm or corporation, other than employees af Permit <br /> the City or persons or entities engaged in performing work under a Required <br /> contract with the City, shall make any excavation in any street, � <br /> alley, easement or other public place in the City of Decatur, <br /> Illinois, for any purpose without first obtaining a permit in <br /> writing from the Department of Public Works. <br /> (Amended by Ordinance 77-20, February 7, 1977) <br /> 2 . Any person, firm or corporation making an application for Insinrance <br /> a permit to make an excavation in any street, alley, easement and Bond <br /> or other public place in the City of Decatur, Illinois shall pro- <br /> vide the following insurance and bond: <br /> (a) Workmen' s Compensation Insurance for all their employees <br /> and all employees of their sub-contractors . A certificate of <br /> said insurance shall be filed with the City Clerk before a permit <br /> is issued. <br /> (b) Public Liability Insurance in the amount of $100 ,000/ <br /> $300 ,000 for injury or death of persons , and property damage <br /> liability insurance in the amount of $100 ,000 with the City of <br /> Decatur, Illinois as named insured. Said insurance shall cover <br /> the use of all equipment, including but no limited to excavating <br /> machinery, trenching machines, cranes , haists , rollers , concrete <br /> mixers , motor vehicles , and open cuts and trenching. A certifi- <br /> cate of said insurance shall be filed with the City Clerk of <br /> the City of Decatur, Illinois before a permit is issued. <br /> Said insurance must provide that a thirty (3) day notice <br /> will be given to the City of Decatur, Illinois , before cancellation. <br /> (c) A surety bond in the penal sum of $3,000. 00 as security <br /> against faulty or defective workmanship and materials and to cover <br /> any loss or expenses caused by the failure of the Contractor to <br /> construct the work according to specifications. The bond shall <br /> reamin in effect for a period of three (3) years from the time of <br /> construction. <br /> 3. Street excavation permits will be issued by the Engineering Appli- <br /> Division upon written applications filed with the Division. Appli- cation <br /> cations and permits shall be on forms provided by the City. and <br /> Permit <br /> The application shall state the location, and in case of a <br /> new water or sewer service, the legal .description of the property <br /> to be served, and the dimensions of the proposed opening, the pur- <br /> pose for which the opening is to be made , the kind of pavement or <br /> surface to be opened and the approximate date that the opening will <br /> be made. <br />
