77-02 EXTENDING TIME LIMITATIONS FOR COMPLETION OF RESIDENTIAL DEVELOPMENT PLAN IMPROVEMENTS

, . ;� . 2 � (b) That befoze applying for a building permit, appli- cable to said premises, and before commencing any construction or any improvemEnt on said premises, pQtitioner cause to be prepared detailed plans and specifications� including design data for sani- tary se�vers, watermains, surface water drainage and drains, streets, sidewalks, driveways, parking lots, entrances, fire hydrants and utilities and submit the same to and obtain the approval in writing of the Director of Public Works and the Director of Community De- velopment of the City of Decatur, Illinois, of said plans and speci- fications and that which is shotvn therein. ! (c) That before applying for a building permit applicable �+ to said premises, petitioner cause the facilities mentioned in sub- paragraph (b) hereof to be constructed in conpliance with the plot plan aforesaid and in compliance with said approved plans and speci- fications, and with aIl applicahle codes and ordinances of the City, � or that petitioner furnish bond in such amount as may be determined a by the Director of Public Works and in such form and with such surety as may be approved by the Council upon the recommendation of the Corporation Counsel, conditioned upon such construction wi.thin two years from the date hereof of any part of said facilities not so con- structed before such building permit is applied for. (d) That in the development of said premises under the special permit and tre construction of any and all improvements therein, petitioner comply with aIl applicab�e building, construction, mechan- �ical, zoning and use codes and ordinances of the City. (e) That before applying for a building permit appZicable to said premises petitioner cause to be dedicated anci conveyed to the City all utility easements shown on said plot plan and all srreets and right-of-way shotivn thereon, along �vith alI water mains, sev��ers, surface water drains and appurtenances to the same and twenty feet off the entire East end of said pzemises adjacent to 1Vorth Woodford Street for use by the City as right of way for said street, or petitioner furnish bond as aforesaid in such amount, form and with such surety as may be approved by the Council upon the recommendation of the Director of Public Works and Corporation Counsel, conditioned upon such dedication and conveyance v�ifhi n two years of the date hereof. (f) That the aforesaid conditions and the improvements re- quired to be constructed, provided, furnished and improved and the de- dication and com�eyances required herein be completed not later than two years from the dat2 of the passage of this ordinance. Section 3. That said special use permit granted hereby be, and the same is hereby, made subject to the applica6le provisions and requirements of the Zoning Ordinance of the City of Decatur, Illinois, - the same being Ordinance No. 3512, as amended, and that thE Zoning Map of thp City be amended in accordance here�vith. Section 4. That should petitioner fail to perform any of all of the aforesaid conditions within the time limited for the per- formance thereof, this permit shall terminate and be revoked.
