< <br /> • ,• . ;,' ' � �,►.-Q_. � � _ l �3 <br /> - � �� V � � ��� <br /> ORDINANCE NO. � ( � �, <br /> ORDINANCE GR.ANTING PERMIT FOR R-6 RESIDENCE DEVELOPMENT PLAN <br /> WHEREAS, on the 4th and lOth days of November, 1976 , after notice <br /> as required by law and ordinance, the Decatur City Plan Commission held <br /> a public hearing upon the petition of PHILLIP C. MILLER AND OTHERS for <br /> a Special Permit under the provisions of Section XXI C. of the Zoning <br /> Ordinance to construct and operate azR-6 Residence Development Plan on <br /> premises described as : <br /> Lots 2, 3 , 4 and 5 of Sheets Addition of Outlots to <br /> Decatur, as per Plat recorded in Book 646 , Page 302 <br /> of the Records in the Recorder' s Office of Macon <br /> County, Illinois, except the East 160 feet of the <br /> South 200 feet of said Lot 2 and the East 240 feet of <br /> the North 186. 2 feet of said Lot 4 ; <br /> and, <br /> WHEREAS, the said City Plan Commission has reported to the Council <br /> and has recommended approval of said Residence Development Plan and that <br /> the same be permitted upon the conditions and limitations hereinafter <br /> set out. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS : <br /> Section l . That upon the conditions and limitations hereinafter <br /> set out a Special Permit be, and it is hereby, granted to PHILLIP C. <br /> MILLER AND OTHERS to develop, construct and operate upon the premises <br /> aforesaid an R-6 Residence Development Plan in accordance with the plot <br /> and plan thereof hereto attached, marked Exhibit A and hereby made a part <br /> hereof. <br /> Section 2. That the Special Permit authorized hereby be, and the <br /> same is hereby, expressly limited and conditioned as follows : <br /> a. That said premises be developed in accordance with the plot <br /> and plan aforesaid for residential and incidental uses as shown thereon <br /> and none other and that all driveways , entrances, walkways, hydrants, <br /> public utilities , buildings and other structures and improvements be <br /> substantially located and implaced and landscaped as shown on said <br /> Exhibit A, and further that the residential buildings , parking areas and <br /> roadways be constructed of the approximate size, number and placement <br /> as shown on said Exhibit A and as referred to in the Schedule dated <br /> November 1, 1976 , hereto attached, marked Exhibit B and hereby made a <br /> part hereof. <br /> b. That the development of said described premises may be <br /> developed in stages or phases as outlined in light blue on said Exhibit <br /> A and designated by Roman Numerals I thru VII. <br /> c. That before commencing any construction or development of <br /> each respective phase on said site , for each such phase to be developed <br /> petitioners cause to be prepared detailed plans and specifications includ- <br /> ing design data for streets , parking lots , curbs , gutters , sidewalks, <br />
