<br /> Section 3. That said permit be, and the same is hereby, further
<br /> expressly conditioned as follows :
<br /> � ' (a) That the site for said Residence Development Plan be
<br /> developed and the lots, spaces , streets, curbs, gutters, sidewalks
<br /> and other improvements and those to be constructed, maintained,
<br /> operated and used be developed as shown by the site plan hereto attached
<br /> and marked Exhibits A and B and designated Residence Development Plan,
<br /> Sims Knolls Addition, Sheets #A-2 and A-3, prepared by Warren E. Hagan,
<br /> and hereby made a part hereof.
<br /> (b) That before commencing any construction or development
<br /> on said site, petitioners cause to be prepared detailed plans and
<br /> specifications, including design data for streets, parking lots, curbs,
<br /> gutters, sidewalks, sanitary sewers, water mains, surface water drainage
<br /> and drains , driveways and driveway and street entrances and all other
<br /> improvements in accordance with the applicable City Codes, ordinances,
<br /> standards, customary specifications, rules and regulations and submit '
<br /> the same to and approve the same in writing by the Department of �'
<br /> Engineering and Director of Public Works of the City of Decatur, Illinois .
<br /> (c) That before applying for a building permit on any part
<br /> of said premises and prior to the construction of any public or
<br /> residential improvements thereon, petitioners shall submit to and
<br /> secure the approval of the City of a preliminary plat under the
<br /> provisions of the Subdivision Ordinance thereof.
<br /> (d) That the Owner's Declaration for the final plat of
<br /> subdivision for said premises make provisions for a Homeowner' s
<br /> Association in a perpetual corporate form to operate and maintain
<br /> Lot 48, as shown on the above mentioned site plan, as a park.
<br /> (e) That in the construction, maintenance and use of said
<br /> residence development plan, petitioners otherwise comply with all
<br /> applicable building, construction, mechanical and use codes and ordinances
<br /> of the City.
<br /> Section 4 . That should petitioners fail to perform any or all
<br /> of the aforesaid conditions, this petition will terminate and be revoked.
<br /> Section 5. That said residence development plan permitted hereby
<br /> be, and it is hereby, made subject to the applicable provisions and
<br /> requirements of the Zoning Ordinance of the City of Decatur, Illinois ,
<br /> the same being Ordinance No. 3512 of the City, as amended, and that a
<br /> Zoning Map of the City be amended as herein set forth.
