J . � . �°f� ss, �c� <br /> � <br /> � � That This Iry�tr�u�t_Was F11ed Far <br /> ORDINANCE N0. 7114 R�oo�d q��L+4� �.M. <br /> � <br /> � � JUL 2 1 i976 � <br /> ORDINANCE GRANTING CONDITIONAL R°�rd�d In Book �8�9 Page 34 <br /> . �� . <br /> AND LIMITED VARIANCE OF MINIMUM 9.�gR''.�ar <br /> Feo„ Recorder of Deeds <br /> PARKING SPACE REGULATIONS MICROFILM <br /> WHEREAS, Oxford Development Corp. , has an option to purchase <br /> the premises in the City of Decatur, Illinois , described as : <br /> Lot 6 of Cremeen' s ��fanor Addition, as per Plat recorded <br /> at Book 1575 , Page 215 of the Records in the Recorder' s <br /> Office of Macon County, Illinois , except the East 590 <br /> feet of said Lot 6 , <br /> and said corporation proposes to construct thereon certain improve- <br /> ments to be used as housing for elderly families of low income ; and, <br /> WHEREAS , said corporation has requested that the parking and <br /> loading regulations of the Cit,y be varied b,y reducing the minimum <br /> number of required motor vehicle parking spaces to be constructed <br /> and maintained on said site appurtenant to said use to one-half <br /> that number which would otherwise be required by said regulations <br /> in the R-6 Multiple Family District ; and , <br /> WH�REAS , said corporation has represented and agreed that any <br /> such variance may be limited and conditioned and said limitations <br /> and conditions may be made a matter of record and a restriction upon <br /> � and in the title of said premises for the benefit of the health, <br /> safety and welfare of the community to , among other things enhance <br /> the quiet , peace and repose of the neighborhood of said premises and <br /> lessen or prevent the congestion of motor vehicles upon its str•eets , <br /> and that the same may be enforced by the City in its own name by any <br /> app�opriat� action including injunctis�n; and, <br /> WHFRFAS , after notice as pr. ovided by law and ordinance , the <br /> Zoning Board of Appeals on June 8, 1976 , held a public hearing upon <br /> such request and did report and recommend that the same be granted <br /> and said regulations be varied as so limited and conditioned. <br /> NOW, THEREFORE , BE �T ORDAINED BY THf? COUTICIL OF TH� CITY OF <br /> DECATUR, ILLINOIS : <br /> Section 1. That the report and recommendation of the Decatur <br /> Zoning Board of Appeals be , and the same is hereby, received, placed <br /> on file and approved. <br /> Section 2 . That the rez�resentation and agreement of said <br /> corporation be , and the same is hereby, attached hereto, made a part <br /> hereof as if fully set out herein, and approved. <br />
