3 <br /> Section 5. That it be, and it i� hereby, authoriaed that <br /> in the case of injury, illness or disability arising out of and in <br /> the cou rse of employment with the City, the City will pay the differ- <br /> ence between such en�loyee's regular salary or wages and any payments <br /> received by the employee from a public employ�e pension fund or under <br /> the provisions of workmen's compensation or occupational disease laws, <br /> or either or both, for the duration of such disability, or a pe riod <br /> of six calendar months from the date of commencement of disability, <br /> whichever is the shorter �riod of time. The deter�aination of whether <br /> su ch injury, illness or disability arose out of and in the course of <br /> employment undeY ttis provision shall be the same as that made on the <br /> workmen's compensation or xcupational disease claim of said employee. <br /> t�dzere said injury, illness or disability was caused under aircumstances <br /> creating a legal liability for damages on the part of some person or <br /> entity other than the City, then if action is brought by the employee <br /> and judgment is obtained and paid, or settlement is made either with <br /> or without suit, then fYom the amount received by such employee the <br /> City shall be reirnbursed for any and all amounts paid hereunder. Out <br /> of any such re imbursement, the City shall pay its pro rata share of all <br /> costs and reasonably necessary expenses in connectiion with such xe- <br /> covery, If the employee does not bring action against such third party, <br /> then the City may i.n tl�e same manner as is provided for recovery of <br /> w�orkmen's compensation payments bxing action either in its name or the <br /> employee 's name for such reimbursement. If any other benefit or payment <br /> is made or required to be made by the City to such employee such shall <br /> be credited to the City against the pa yment of wage or salary provided , <br /> by this sect ion. <br /> Section 6. That the following provisions shall apply to sick <br /> leave with pay for employees in said classified service: <br /> (a) Full time employees in the classified fire fighting ser- <br /> vice shall accrue 1.4 work days with pay sick leave for each month of con- <br /> tinuous service uninterrupted bq resignation or discharge up to a maximum <br /> accumulation of 135 days. <br /> (b) Accumulated sick leave days may be used for illness, in- <br /> jury or off-the-job incurYed disability. 1.4 days of accumulated sick <br /> leave credit with pay shall be deducted fYom such employee 's sick leave <br /> accumulation for each duty day not w�orked due to illness, injury, or off- <br /> the-job incurred disability. <br />
