<br /> Decatur , Illinois, the same being Ordinance No. 3512, as amen ded.
<br /> Sect ion 4. That said permit be, and the same is hereby further
<br /> e:cpressly conditioned as follows:
<br /> (a) That the site for said Residence Development Plan be de-
<br /> veloped and the parking lots, spaces, streets, curb, gutters, side-
<br /> walks and other improvements and those to be constructed, maintainec3,
<br /> operated and used and said site to be otherwise developed as shoua� by
<br /> the Site Plan hereto attached and marked Exhibit A and designated R-2
<br /> Residence Development Plan Butterfly Hills Revised 4-21-75 and pre pared
<br /> by Krimmel & Associates, Inc. and hereby made a part hereof.
<br /> (b ) That petitioners cause to be e�onstructed and dedicated to the
<br /> City of Decatur, Illinois, for public use the public improvements indi-
<br /> cated on said Exhibit A.
<br /> (c) That before commencing any construction or development on said
<br /> site, petitioners cause to be prepared detailed plans and specifications,
<br /> including design data for streets, parking lots, curbs, gutters, side-
<br /> walks, sanitary sew�ers, water mains , surface water drainage and drains,
<br /> driveways and driveway and street entrances and all other improvements in
<br /> accordance with the applicable City Codes, ordinances, standards, custom-
<br /> ary specifications, rules and regulations and submit the same to and ap-
<br /> prove the same in writing by the Depart�nent of Engineeri.ng and Director of
<br /> Publi.c t�,brks of the City of Decatur, Illinois.
<br /> (d) That before applying for a building permit on any part of said
<br /> premises and prior to the canstruction of any public or residential im-
<br /> provements thereon, petitioners shall submit to and secure the approval
<br /> of the City of a preliminary plat under the provisions of the Suhdivision
<br /> Ordinance thereof.
<br /> (e) Tha t Lot Nos. 1, 2, 3 and 7 shall be restricted to single family
<br /> residence use; Lots 4 and 6 shall be restricted to multiple family resi-
<br /> dence use - not to exceed 6 units; and, Lot 5 shall be restricted to mul-
<br /> tiple family residence use - not to exceed 8 units.
<br /> (f) That in the construction, maintenance and use of said residence
<br /> development plan, petitioners otherwise comply with alI applicable building,
<br /> construction, mechanical and u�e codes and ordinances of the City.
<br /> Section 5, That should petitioners fail to perform any or all of the
<br /> aforesaid conditions, this petition would terminate and be revoked.
<br /> Section 6. That said residence development plan permitted hereby be,
<br /> and it is hereby, made subject to the applicable provisions and require-
<br /> ments of the Zoning Ordinance of the City of Decatur, Illinois, the same being
<br /> Ordinance No. 3512 of the City, as amended, and that a Zoning Map of the City
<br /> be amended as he�rein set forth.
