<br /> RESIDENTIAL CARE FACILITIES--
<br /> AND OTHER INSTITUTIONS
<br /> WHEREAS, on April 3, 1975, after notice as required by la w
<br /> and ordinance, the Decatur City Plan Commission held a public
<br /> hearing on the petition of the Director of Community Development
<br /> to amend Ordinance No. 3512, as amended, to define certain uses
<br /> in said petition identifie d and to amend certain use regulations
<br /> as therein set out; and,
<br /> WHEREAS, said Decatur City Plan Commission has reported to
<br /> the Council its recommendations that the Zoning Ordinance, as amen-
<br /> ded, be furthe r amended as in said petition requested.
<br /> NOW� THEREFORE, BE IT ORDAINED BY THE CC7UNCIL OF THE CITY OF
<br /> DECATUR, ILLINOIS:
<br /> Section 1. That the report an d recommendation of the Decatur
<br /> City P1an Commission as aforesaid be, and the same are hereby, re-
<br /> ceived, placed on file and approved.
<br /> Section 2. That Ordinance No. 3512, as amended, the same bping
<br /> the Zor.ing Ordinance of the City, be, and the same is hereby, amended
<br /> at Section II thereof by adding subsections 70 and 7I thereto, saic;
<br /> subsections to pxovide as follows:
<br /> 70. RESIDENTIAI. CARE FACILITY: Any facility, other
<br /> than a foster home, whether operate d for profit or not,
<br /> which through ownership or management provides residential
<br /> care to one or more persons who are not related by blood
<br /> or marriage to either the owner or operator, or one of them,
<br /> or such facility, or any classification of such facilities
<br /> as defined in the Min imum Standards, Rules and Regulations,
<br /> as amended, of the Department of Publi.c Health of the State
<br /> of Illinois, that provides supervised residential care for a
<br /> person, or persons, who because of age, physical or mental
<br /> disability, emotional or behavioral disorder, or mental re-
<br /> tardati on, are incapable of maintaining a private, ind.epen-
<br /> dent residence, or who are incapable of managing their person,
<br /> whether or not under conservatorship or guardianship. Resi-
<br /> dential care facility includes but is not limited to , among
<br /> others, the following: nursing homes, shelter care homes, ha lf-
<br /> way houses, specialized residential care facilities, specialized
<br /> living centers, rehabilitatian homes, and detention homes for
<br /> either juveniles or adults, or both.
