That the above described portion of alley be, <br /> the same is hereby, vacated as a public alley or way subject <br /> to the exceptions , reservations and conditions hereinafter set <br /> out , inasmuch as the same is no longer required for public use <br /> as an alley and the public interest will be subserved by such <br /> vacation and the public �11 be relieved from the further burden <br /> and responsibility of maintaining the same , said portion of <br /> alley being shown on the plat thereof hereto attached and hereby <br /> made a part hereof. <br /> Section 3. That there is hereby reserved in, over, along, <br /> and under the alley hereinabove vacated, to the City af Decatur, <br /> Illinois , and to the public and to those utilities and companies, <br /> as the case may be, owning public service facilities , mains , <br /> sewers, telephone and electrical or other public utilities , such <br /> property, rights of way and easements as are or may be necessary <br /> or desirable for continuing public service by means of such <br /> facilities and for the maintenance, renewal, and reconstruction <br /> thereof with the right of ingress and egress such purposes . <br /> Section 4. That the benefits which will accrue to the <br /> owners of abutting property by reason of the vacation afore- <br /> said is determined to be , in the judgment of the Council, equal <br /> to the sum of $3,500.00. <br /> Section 5. That the vacation herein provided for is made <br /> upon the express condition that there shall be paid to the City <br /> of Decatur, Illinois by or on behalf of the owners of all pro- <br /> perty abutting upon that part of said alley vacated hereby the <br /> amount of $3 ,500. 00 as compensation for the benefits determined <br /> as above set out herein, upon the payment whereof such vacation <br /> shsll become effective.
