ARTICLE VI, LIQUIDA�E� DAMs�GES -- It is hereby fully urderstood and agreed th�-�t ti��e is of the essence in the performance of this contract. For each and every caler�d�r d�}- that elapses between the Contract Completion Date and the date on which the work covered by such contract is actu�lly completed, including the removal of all ptant and obstruc- . tions from the site of such evork, tre Contractor shall pay to the OV•rner as liquidated damages and not as a penalty, the sum of THREE HUPJDRED JOLLARS ($300.00) . The total amo�nt so payable by the Contractor as liquidated damages either may be deducted from any moneys due or payable to the Contractor by the Owner or so much thereof as is not so deducted shall be chargeable to and will be payable promptly by such Contractor and his Surety, or either of them, to the 04•�ner. Such liquidated damages shall be payable to reimburse or compensate, at ieast in part, the Owner for (l ; the administra- tion of the work covered by such contract and any other co7tract or cortracts beyond the Contract Completion Date; (2) expenditures resulting fromthe inability of the Owner (and the general public) to use the improvement being constructed from and after such Contract Completior Date until the actual date of completion; (3) other miscellaneous abligations and expenditures incurred by the Owner directly as a result of the failure to complete the work covered b�� such contract on or before the Contract Completion Date. ARTICLE VII, ILLINOIS LABORERS - The Contractor agrees, under the terms of this con- tract, to employ only laborers vaho are residents of the State of Illinois, with the provision that other laborers may be used when Illinois laborers are not available, or when Iltinois laborers are incapable of performing the particular type of work involvzd, if so certified by the Contractor in wr•iting and approved by the Owner. Exhibit 1 - Non-Discrimination Act In the event that any provision in any of the foregoing component parts of this contract conflicts with any provision in any other of the component parts, the pro- vision in the component part first enumerated shall govern over any other component part which follows it numerically, except as may be otherwise specifically �stated.
