ORDINANCE NO. �j� AN ORDINANCE GRANTING SPECIAL USE PEF�+IIT - RESIDENTIAL SPECIAL EDUCATIONAL SCHOOL WHEREAS, on the 6th day of January, 1972, after notice as required by law and ordinance , the Decatur City Plan Commission held a pu blic hearing upon the petition of JAMES SEE AND OTHERS for a special use permit to construct, maintain and operate a private residential school providing special educational facili- ties on premises in the City of Decatur , Illinois, described as: The East 22-1/3 acres of the Southeast Quarter of the Southeast Quarter of Section Nineteen (19), Township Sixteen (16) North, Range Three (3) Ea st of the Third Principal Meridian except the East 130 feet of the Nozth 335.08 feet thereof, except also beginning 736.7 feet West and 873.92 feet North of the Southeast Corner of said tract, thence North 450.93 feet, thence East 199.35 feet, thence South 450.93 feet, thence West 187.05 feet to the place of beginning; except also a tract of the Southeast Quarter of the Southeast Quarter of Section Nineteen (19 ), Township Sixteen (16) North, Range Three (3) East of the Third Principal Meridian, described as the West 138.5 feet of the East 251.5 feet of the North 238.0 feet, subject to the Northerly portion within the right-of-way of Fulton Avenue, situated in the County of Macon, State of Illinois; and WHEREAS, said Decatur City Plan Commission did recommend that said special use permit be granted and did file a report of its f indings with the Council in support of said recomme ndation. NOW THEREFORE, BE IT ORDAINED BY THE OOUNCIL OF THE CITY OF DECATUR� ILLINOIS: Section 1. That the findings and recommendations of the Decatur City Plan Commission be received, placed on file and approved. ' Section 2. That upon the conditions hereinafter mentioned, an R-2 Special Use Permit to construct, maintain and operate a private residential school providing special educational facilities upon the premises aforesaid be, and the same is hereby, granted petitioners. Section 3. That said special use permit be, and it is hereby, conditioned as provided in Section XXI. A. 1. (1-6) of the Zoning Or- dinance of the City of Decatur, Illinois, the same being Ordinance No. 3512, as a�ended, and upon the further condition that said school hereby permitted be licensed by and meet all the applicable rules and regulations of the State of Illinois in force from time to time with regard to the construction, maintenance and operation of such facility.
