The CITY wi11 not authorize or permit any operation, practice or <br /> encroachment on the completed imp�ovement which wiil change, impede or <br /> interrupt the orderly flow of vehicular treffic without the prior approval . <br /> of the STATE and the Federal .Highway Administration and to enforce such traf- <br /> fic reguTations and tocat ordinances as affect traffic operations on the <br /> completed improvement. It is understood that failure on� the part of the CITY � <br /> to fulfill the t-esponsibility assigned here and under items 3 and 7 above <br /> and 11 below will disquaTify the CITY for Federal-aid participat�on in fut- <br /> ure p�ojects for -which the CITY has similar responsibilities until appro- � <br /> priate corrective measu�es are taken. <br /> 11. The CITY agrees to maintain a traffic engineering unit within <br /> � its governmental structure or to provide other means acceptable to the STATE <br /> and the U.S. Department of Transportation, Federal Highway Administration <br /> for assuring proper maintenance and operation of the completed improvement. <br /> T2. The CITY shall exercise its franchise right to cause private <br /> utilities to be relocated at no expense to the STATE. <br /> . � 13. The CITY agrees not to permit driveway ent�ance openings to be <br /> made in the curb, as constructed without the consent of the STATE. <br /> 14. This agreerr�cst and the covenants contained herein shait become <br /> nuTl and void in the event the contract covering the construction �work con- <br /> templated F�erein is not awarded by July 1 , 1973. <br /> . � <br /> 15.
