WHEREAS, said right-of-way is no longer useful to the public or to the City; and, WHEREAS, the public interest will be subserved by vacating said right-of-way and the public will be relieved from the further burden and responsibility of maintaining the same. WHEREAS, all appropriate utility companies were contacted and expressed no objections to the proposed vacations; and NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That upon the condition set forth below, the above described right-of-way be, and the same is hereby, vacated inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said right-of-way being shown on the plat thereof hereto attached and hereby made a part hereof. A. A blanket easement for the vacated Mercer St right-of-way shall be maintained for all utilities located within the right-of-way, including but not limited to the City's utilities.
