ORDINANCE NO. 2021- �q <br /> ORDINANCE AUTHORIZING CONSUMPTION OF ALCOHOLIC LIQUOR <br /> ON PUBLIC RIGHTS-OF-WAY 2200 BLOCK EAST HICKORY STREET BETWEEN <br /> NORTH 22nd STREET AND NORTH 23rd STREET DECATUR LODGE #401 OF THE <br /> BENEVOLENT AND PROTECTIVE ORDER OF THE ELKS OF THE UNITED <br /> STATES OF AMERICA BIKE NIGHT-JUNE 17, 2021 <br /> WHEREAS,Decatur Lodge#401 of the Benevolent and Protective Order of the Elks of the <br /> United States of America has requested the closure of the 2200 Block of East Hickory Street between <br /> North 22'Street and North 23rd Street for Decatur Lodge#401 of the Benevolent and Protective Order of <br /> the Elks of the United States of America Bike Night; and, <br /> WHEREAS, it is the intention of Decatur Lodge#401 of the Benevolent and Protective Order of <br /> the Elks of the United States of America to offer alcoholic beverages for sale to patrons for consumption <br /> at this event; and, <br /> WHEREAS, such consumption of alcoholic liquor in the 2200 Block of East Hickory Street <br /> between North 22'Street and North 23rd Street requires the express approval of the City Council. <br /> NOW,THEREFORE,BE IT ORDAINED,BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR,ILLINOIS: <br /> Section 1.That on the day listed herein,and only on such day,between the hours listed opposite <br /> said day,alcoholic beverages may be consumed in the 2200 Block of East Hickory Street between North <br /> 22nd Street and North 23' Street,said day and hours being particularly described as follows: <br /> Thursday,June 17,2021 6:00 p.m.-8:00 p.m. <br /> Section 2. That no alcoholic beverage may be consumed as provided herein unless such alcoholic <br /> beverage is in a plastic or paper cup. <br /> Section 3. That this ordinance is expressly conditioned and approved upon Decatur Lodge#401 <br /> of the Benevolent and Protective Order of the Elks of the United States of America providing to the City <br /> of Decatur an agreement which will hold the City of Decatur harmless for any and all damages incurred <br /> by persons attending this event and indemnifying the City for any and all damages and lawsuits. <br /> Section 4.That all debris shall be removed by Decatur Lodge#401 of the Benevolent and Protective <br /> Order of the Elks of the United States of America prior to reopening public rights-of-way. <br /> Section 5.That except as otherwise provided herein,the provisions of Section 34(a)of Chapter <br /> 52 of the City Code remain in full force and effect. <br /> PRESENTED,PASSED,APPROVED AND RECORDED this 7th day of June, 2021. <br /> Julie-mo,-ore Wolfe, or <br /> ATT ST: ` <br /> City Clerk <br />
