ORDINANCE NO. 2012-63 <br /> ORDINANCE AMENDING CITY CODE <br /> - CHAPTER 52— ALCOHOLIC LIQUOR - <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That Section 34 of Chapter 52 of the City Code of the City of Decatur, <br /> Illinois, be, and the same is hereby, modified and amended so that said Section 34 as so <br /> modified and amended shall provide as follows: <br /> 34. CONSUMPTION OR POSSESSION OF ALCOHOL IN AN OPEN <br /> CONTAINER IN PUBLIC PLACES. <br /> A. Alcoholic liquor shall not be consumed or possessed in an open <br /> container at anytime within the City at, in or on the following places: <br /> (1) The right of way of any public highway, street or alley, except as <br /> otherwise expressly provided in this Code; <br /> (2) Central Park, except as otherwise expressly provided in this Code; <br /> (3) The Central Business District, as defined in this Code; <br /> (4) The Street Division and Transit buildings, garages and grounds; <br /> (5) The South Water Treatment Plant and grounds; or any firehouse. <br /> B. The Council may provide by ordinance for the consumption or <br /> possession of an open container of alcoholic liquor, or the consumption or <br /> possession of an open container of wine and beer only, and provide for the <br /> regulation of the manner of such consumption or possession of an open container, <br /> for limited periods of time at, in or on any or all of, or any portion of,those places <br /> listed in Section 34A of this Chapter. <br /> Section 2.
