RESOLUTION NO. R2010-120 <br /> RESOLUTION ACCEPTING THE BID AND AUTHORIZING <br /> THE EXECUTION OF A CONTRACT FOR <br /> BRUSH COLLEGE ROAD PAVEMENT, CITY PROJECT 09-26 <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1. That the tabulation of bids received for City Project 09-26, Brush <br /> College Road Pavement project be, and they are hereby, received and placed on file. <br /> Section 2. That the bid of Otto Baum Company, Inc., be accepted and a contract <br /> awarded accordingly and that said contract between Otto Baum Company, Inc. and the <br /> City of Decatur be, and it is hereby modified, so that as modified, said contract authorizes <br /> a Contingency in an amount not to exceed $31,149 for a total contract amount not to <br /> exceed $595,000. <br /> Section 3. That the changes in the above-described agreements are germane to <br /> said contract, as signed, and such changes are in the best interest of the City of Decatur <br /> and are authorized by law. <br /> Section 4. That the Mayor and City Clerk be, and they are hereby authorized and <br /> directed to execute a contract between the City of Decatur, Illinois, and Otto Baum <br /> Company, Inc., for said plan for their bid price of $563,851 plus contingencies in the <br /> amount of$31,149 for a total not to exceed cost of$595,000. <br /> PRESENTED and ADOPTED this 7th day f June, 2010. <br /> � <br /> � <br /> / <br /> A .
