� � i � ORDINANCE NO. 2001-15 ORDINANCE GRANTING SPECIAL PERMIT CELLULAR COMMUNICATIONS TOWER - 2320 NORTH OAKLAND AVENUE - WHEREAS, on the lst day of March, 2001, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Nextel Partners, Inc., for a special permit under the provisions of Section XXI(A)(1)(j) of the Zoning Ordinance to construct, operate and maintain a freestanding 190 foot monopole cellular communications tower and equipment buildings, on property located in the City of Decatur, Illinois and legally described as follows: Lot Two (2) of Sims-Hazelrigg Addition, as per Plat recorded in Book 1832, Page 601 of the Records in the Recorder's Office of Macon County, Illinois; and, WHEREAS, said Decatur City Plan Commission recommended that such special permit be approved. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendation and report of the Decatur City Plan Commission be, and the same are hereby, received,placed on file and granted. Section 2. That upon the conditions hereinafter mentioned, a special permit be, and it is hereby, granted to Nextel Partners, Inc., and only to Nextel Partners, Inc., to construct, operate and maintain a freestanding 190-foot high monopole type cellular communications tower and equipment buildings upon the premises aforesaid in accordance with the plat thereof hereto attached marked E�ibit A and hereby made a part hereof.
