n . � . . , ORDINANCE NO. � — 3 1 ORDINANCE VACATING PORTION OF AN ALLEY - LOCATED GENERALLY NORTH OF GRAND AVENUE BETWEEN MAIN AND WATER STREETS - WHEREAS, a request has been received from Decatur Memorial Foundation, an Illinois not-for-profit corporation, the owner of property abutting thereon requesting vacation by the City Council of a portion of that alley located generally north of Grand Avenue and between Main and Water Streets in the City of Decatur, Illinois, said portion of said alley being more particularly described as: Beginning at the Southwest Corner of Lot 5 of Assessors Subdivision of Lot 1 as recorded in Book 149 Page 411 of the records in the Recorder's Office of Macon County, Illinois, said point being on the East line of a 16 foot dedicated alley; thence South 422.95 feet along the East line of said alley to a point on the North right-of-way line of Grand Avenue, said point also being 19 . 95' North of the Southwest Corner of Lot 3 of Assessors Subdivision in SE 1/4 of NE 1/4 of Sec. 10, T16N, R2E, 3rd P.M. , as recorded in Book 149 Page 143 of the records in said Recorder's Office; thence West 16 feet along the North right-of-way of Grand Avenue to a point on the West line of said alley, said point being 19 . 95' North of the Southeast Corner of Lot 4 of B. Dills Subdivision as recorded in Book 149 Page 47 of the records in the Recorder' s Office; thence North 422 . 95 ' feet along the West line of said alley to a point located 10 feet North of the Southeast Corner of Lot 12 of said B. Dills Subdivision; thence East 16 feet to the point of beginning, containing 0. 16 acres, more or less; ' and, WHEREAS, said portion of said alley is no longer useful to the public or to the City or to the owners of property abutting thereon as an alley; and, WHEREAS, the public interest will be subserved by vacating said portion of said alley and the public will be relieved from any further burden or responsibility for maintaining said portion of said alley. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section l. That the above-described portion of said alley be, and the same is hereby, vacated as a public alley effective and upon the exceptions and conditions hereinafter provided, inasmuch as the same is no longer required for public use and the public interest will be subserved by said vacation, said portion of said alley being shown on the plat thereof hereto attached and hereby made a part hereof.
