DECATUR FIRE DEPARTMENT Bid Documents <br /> FIRE STATION 1,2,4,AND 6 PHASE 2 RENOVATIONS January 31,2018 <br /> DECATUR,ILLINOIS Dewberry Architects Inc. 50083270 <br /> .4 Reduction of retainage shall be subject to agreement by both the Architect and <br /> the Owner. <br /> (5) Subparagraph 9.7.1 is amended by deleting the words "or awarded by arbitration" from <br /> line 6 and adding the following words and punctuation after the comma following the <br /> word"may"in line 7: <br /> unless non-issuance of the Certificate for Payment or nonpayment relates to an <br /> unresolved dispute concerning Contractor's performance of the Work, <br /> (6) Paragraph 9.8 SUBSTANTIAL COMPLETION: Add the following to Subparagraph <br /> 9.8.1.1 A "Certificate of Substantial Completion:, AIA Document G704", will be <br /> issued to the Contractor upon satisfactory completion of the preliminary Punch List items <br /> in accordance with the provisions states thereon. <br /> (7) Add the following Subparagraph 9.8.6: <br /> 9.8.4 If the Architect determines, in response to the foregoing Subparagraphs 9.8.1 <br /> and 9.8.2, 9.8.3, 9.8.4, and 9.8.5 that the Work is not sufficiently completed or corrected <br /> to justify said inspection, he may decline to make said inspections until the Work has <br /> been more fully completed or corrected. <br /> H. ARTICLE 11 INSURANCE AND BONDS: <br /> (1) Delete Article 11 in its entirety,replace with the following: <br /> 11.1 CONTRACTOR'S LIABILITY INSURANCE <br /> 11.1.1 The Contractor shall purchase from and maintain in a company or companies <br /> lawfully authorized to do business in the jurisdiction in which the Project is located, such <br /> insurance as will protect the Contractor from claims set forth below which may arise out <br /> of or result from the Contractor's operations under the Contract, and for which the <br /> Contractor may be liable, whether such operations be by the Contractor or by a Sub- <br /> contractor or by anyone directly or indirectly employed by any of them,or by anyone for <br /> whose acts any of them may be liable: <br /> 1 claims under workers' or workmen's compensation, disability benefit, and other <br /> similar employee benefit acts which are applicable to the Work to be performed; <br /> .2 claims for damages because of bodily injury, occupational sickness or disease, or <br /> death of the Contractor's employees; <br /> .3 claims for damages because of bodily injury, sickness or disease, or death of any <br /> person other than the Contractor's employees; <br /> .4 claims for damages insured by usual personal injury liability coverage which are <br /> sustained(1)by a person as a result of an offense directly or indirectly related to <br /> employment of such person by the Contractor,or(2)by other person; <br /> .5 claims for damages, other than to the Work itself, because of injury to or <br /> destruction of tangible property,including loss of use resulting therefrom; <br /> .6 claims for damages because of bodily injury, death of a person or property <br /> damage arising out of ownership,maintenance or use of any motor vehicle;and <br /> SUPPLEMENTARY CONDITIONS 007300-8 <br />
