Review is campl�te and this Agreement has been executed by both parties {24 CFR Sect. <br /> 570.5Q3 (aj).The Environmental Review shal) be completed by the City, and shall be <br /> executed in a timely manner. <br /> • The SUBRECIPIENT understands that this Agreement is for a Public Services <br /> Pragram and the payments shall be made per the schedule in Appendix C. <br /> • The SUBRECIPiENT understands that disbursement will be cantingent upon the <br /> SUBRECIPIENT ensuring compliance with any applicable federal, state, and CITY <br /> rec{tairements. <br /> • No disbursement will be made by the CITY unless a!! required report {including <br /> beneficiary, performance, financia(, and narrative reparts, and source <br /> documents for CDBG-funded expenditures} have been submitted and approved <br /> by the CITY staff. Payment may be withheld pending receipt and approval of all <br /> required documentatiort. <br /> VIII. SUSPENSItJN OR TERMtNAT10N: <br /> • Suspension or Termination for Cause bv ClTY:The SUBRECIPIENT understands <br /> and agrees that if SUBRECIPIENT materially fails to comply with any or all <br /> provisions af this Agreement,the City may in its sole diseretion suspend or <br /> terminate this Agreement 24 CFR570.503 (b)(6). <br /> 1.. Material nan-compliance includes, but is not limited to,the foilawing: <br /> a, Failure to comply with any of the rules, regulations, or <br /> provisions referred ta herein, or such statutes, regulatians, <br /> executive arders, and NUD guidelines,"policies, or directives as <br /> may become applicable at any time; <br /> b. Failure,#or any reason,of the SUSRECIPIENT t�fulfill in a timely <br /> and proper manner its obligations under this Agreement; <br /> e. Ineffective ar improper use af funds provided under this <br /> Agreement; or <br /> d. Submissian of reports by the SUBRECIPIENT to the CITY which <br /> are late, or incorrect or incomplete in any material respect. <br /> 2. As a result af material non-campliance,the CITY may take one or mare <br /> o#the fatlowing actions: <br /> a. Tempararily withhold cash payments pending correction of the <br /> deficiency by the SUBRECIPlENT. More severe enfarcement <br /> action may be undertaken by the CITY if the deficiency is not <br /> corrected; <br /> b.
