No payment request made pursuant to subparagraph 1 af this Section V shall exceed the estimated maacimum total amount and value of the total work and services ta be perfarmed by the Professiana! Service Provider under tl�is Agreement for that phase or additionat service without the prior authorizatian of the City's Representative. These estimates have been prepared by the Professional Service Provider and supplemented or acco�rzpanied by such supporting data as rnay be required by the City's Representative. 4. Upon receipt of a prpperly invoiced payment request,the City shatl pay the amount due less any amaunts allowed ta be retained or withheld by the City ur�der this Agreennent within b0 days af receipt af the invaice. 5. The Professional Service Provider and City hereby expressly acknawledge and agree that the Local Governmen#Prompt Payment Act does not appty to this Agreement. E.
