1. General Duties. The Professional Service Provider shall cottsult with and advise the City's <br /> Representative and act as its representative as provided herein and in tlle General Conditions of <br /> the construction contract for the Project. The primary responsibility of the Professional Service <br /> Fcovider in this phase of the work shall be quality control inspection of the materials,constructian <br /> methods and techniques ta assure that the Contractor builds the praject in accardance with the <br /> plans and specifications. <br /> 2. Construction Inspection and Reparting The Professional Service Provider shall make visits to <br /> the site at intervals apprapriace to the various stages of constructian to observe as an experienced <br /> and qualified design professional the pragress and quality af the executed work nf the Contractor <br /> and to determine in generat if such work is proceeding in accordance with the Cantract <br /> Documents. 17uring such visits and on the basis of on-site observations,the Prafessianal Service <br /> Provider shall keep the Ciky's Representative informed of the progress of the wark,shalt <br /> endeavor to guard the City against defects and deficiencies in such work and may disapprove or <br /> reject work failing ta conforrn to the Caniract Docurnents. FQnnal notification of the progress of <br /> work shall be in the form af bi-weekty praject progress meetings held between the PrafessionaI <br /> Service Provider,Contractar and City's Representative. Project schedule updates shall be <br /> submitted ta the City's Representative in writing. <br /> 3. Review of Technicat and Proeedural Aspects The Professional Service Provider shali review and <br /> approve(or take other apprapriate action in respect ta Shop Drawings,the results of tests aad <br /> inspectians and other data which each Contractor is required to submit,determine the <br /> acceptability af substitute cnaterials and equipment proposed by the Contractor(s),and receive <br /> and review(far general coiYtent as required by the Specifications)maintenance and operating <br /> instructions,schedulas,guarantees, bonds and certificates of inspectian which are to be <br /> assembled by the Cantractor(s). <br /> 4. Cantract Documents. The Professional Service Provider shall receive frarn each Contractor and <br /> review for compliance with contraet daeurnents all required document submissions including but <br /> not timited to Performance and Payment Bonds,certificates af insurance report forms required by <br /> any City, State ar Federal law or rule or regulation and submit the forms to the City's <br /> Representative for final appraval. <br /> 5. Contract Interpretation;Review of(��alitv af Work The Professionat Service Pravider shall: <br /> a. Issue all instructions ofthe City's Representatiue to the Gontractor(s}. <br /> b. Issue necessary interpretations and clarifications af the Cantract Documents and in <br /> connection therewith prepare change orders as required,subject to the City's Representative's <br /> approval. <br /> c. Have authority,as a representative of the City,to require special inspection or testing of the <br /> work. <br /> d. Act as initial interpreter af the requirements of the Contract Dacuments and judge of the <br /> acceptability of the wark there ander and�nake decisions an all claims of the Contractor{s} <br /> reiating to the acceptabitity of the wark or the interpretation of the requirements ofthe <br /> Contract Documen#s pertaining to the execution aad progress af the wark. <br /> 6. Authori and Responsibilit,� The Professional Service Provider sha(1 nat guarantee the work of <br /> any Cantractor or Subcontractor,shall have no authority to stap work,shatl have no superv'rsion <br /> or contral as ta the wark or persons doing the work,sha(1 not have charge of the work, shall not <br /> be respansible for safety in,on,or about the job-site or have any cantrol af the safety or adequacy <br /> of any equipment,building component,scaffolding,supparts,forms or other wark aids,and shall <br /> Lasc Revised:Q512112Q18 <br />
