and is willing to lease the same from the City of Decatur pursuant to the terms <br /> and conditions herein set forth, and <br /> WHEREAS, by the authority granted Decatur under Section 6 of Article VII <br /> of the Illinois Constitution as a home rule unit of local government, Decatur may <br /> enter into this Intergovernmental Lease Agreement with the City of Charleston, <br /> and <br /> WHEREAS, by the authority granted Charleston under the Illinois <br /> Municipal Code, Charleston may enter into this Intergovernmental Lease <br /> Agreement with the City of Decatur, and <br /> WHEREAS, the Illinois Constitution and statutes, including without <br /> limitation the Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.), and <br /> Article VII Section 10 of the 1970 Illinois Constitution encourage and permit <br /> intergovernmental cooperation between units of local government, and <br /> WHEREAS, the Illinois Intergovernmental Cooperation Act provides that <br /> any one or more governmental agencies may contract with any one or more <br /> governmental agencies to perform any governmental service, activity or <br /> undertaking which any of the public agencies entering into the contract is <br /> authorized by law to perform provided such contract shall be authorized by the <br /> governing body of each party to the contract.
