7. Maintenance and Repairs. Lessee agrees to keep the leased premises clear of trash and rubbish.
<br /> Owner shall not have any duty or obligation to Lessee or Lessee's guests or invitees to remove snow or ice or any
<br /> other elements from any portion of the leased premises,including entryways,sidewalks,stairs,driveways,or other
<br /> areas of ingress or egress,regardless of whether any such accumulations are natural or unnatural. To prevent
<br /> damage to the leased premises,Lessee agrees to maintain an interior temperature of not less than 60°or more than
<br /> 80°. Lessee shall keep the yard adjacent to the house and garage mowed. Lessee shall not trim any existing trees
<br /> without the advance consent of Owner.
<br /> Lessee agrees to reasonably maintain,at the expense of Lessee,the exterior walls and structural portions of
<br /> the leased premises,roof,heating system,plumbing and pipes,well,sewage system,drainage system,and electrical
<br /> system to the extent such items require maintenance as a result of ordinary wear and tear,aging or other causes and
<br /> shall bear the cost and expense of periodic septic tank cleaning or waste removal,and for repair or maintenance of
<br /> clogged drains or toilets resulting from acts of Lessee,their guests or invitees. Lessee agrees to maintain,at expense
<br /> of Lessee,all kitchen appliances,interior fixtures and light bulbs. Lessee agrees that Lessee's repair,maintenance or
<br /> replacement of any items which are the property of Owner shall be subject to advance written notification to Owner
<br /> of the need for such repair,maintenance or replacement and receipt of Owner's advance approval of the desired
<br /> repairs,maintenance or replacement by Lessee or Lessee's designee.
<br /> Lessee agrees to promptly notify Owner of any items which Lessee knows or reasonably should know are
<br /> in need of maintenance,repair,removal or replacement,or any other items or conditions which Lessee knows or
<br /> reasonably should know may constitute or create a dangerous or hazardous condition. Absent Owner's negligence,
<br /> Owner shall have no liability to Lessee,Lessee's guests or invitees for any loss or damage caused by any failure to
<br /> make any repairs or perform.
<br /> Upon termination of this Lease,Lessee shall surrender the premises in the same condition in which it was
<br /> received,absent normal wear and tear.
<br /> 8. Pets and Waterbeds. Owner and Lessee agree that no pets shall be brought on the premises or
<br /> remain on the premises without the prior consent of Owner. Owner and Lessee agree that Lessee shall not have a
<br /> waterbed in the residential premises without the prior consent of Owner. Owner consents to the following pets
<br /> owned by Lessee currently existing at the premises:
<br /> 9. Insurance. Lessee agrees to purchase insurance coverage to protect the personal property and
<br /> belongings of Lessee from damage by whatever source,including,but not limited to,damage by theft,fire,casualty
<br /> and water damage which may result from broken water pipes or plumbing or damage to Lessee's property which
<br /> may occur as a result of malfunction of the sewage or drainage system and other like sources of damage. Lessee
<br /> further agrees to obtain liability insurance to protect Lessee from claims that may be brought against Lessee by any
<br /> persons or entities for any reason whatsoever. Owner and Lessee specifically agree and understand that no portion
<br /> of the monies paid by Lessee to Owner is in any way being utilized by Owner to purchase insurance protection in
<br /> any form for Lessee and that insurance coverage obtained or maintained by Owner is solely for the protection of
<br /> Owner's interest in the premises and solely for the benefit of Owner and not for the benefit of Lessee. Lessee
<br /> specifically understands and agrees that any failure of Lessee to obtain and maintain insurance coverage for the
<br /> benefit of Lessee will result in Lessee assuming the risk of incurring loss as a result of the occurrence of potential
<br /> damages or claims as described in this paragraph 8.
<br /> 10. Indemnification. Lessee shall indemnify Owner and the leased premises and all improvements
<br /> placed thereon from all claims,liens,claims of lien,demands,charges,encumbrances,or litigation arising directly
<br /> or indirectly out of or by reason of any activity of Lessee,Lessee's agents or designees on the premises. Owner shall
<br /> not be liable for any loss,injury,death or damage to person or property which at any time may be suffered or
<br /> sustained by Lessee,Lessee's guests or invitees or by any person who may at any time be using or occupying or
<br /> visiting the leased premises or be in or about the same,whether such loss,injury,death or damage shall be caused
<br /> by or in any way result from or arise out of any act,omission,or negligence of Lessee,Lessee's agent,or of any
<br /> occupant,guest,licensee,invitee,or other user of any portion of the premises or shall result from or be caused by
<br /> any other matter or thing,whether of the same kind or of a different kind than the matters or things above set forth,
<br /> unless caused by or resulting from or arising out of any acts,omission or negligence of Owner,or Owner's agent.
