thereafter. If any deficiency is identified, a follow-up on-site inspection is required <br /> within twelve (12) months. Health and safety deficiencies identified during the <br /> inspection must be corrected immediately and more frequent inspections may be <br /> scheduled for the property at the City's discretion. Owner must submit an annual <br /> certification to the City certifying that the building and all HOME-assisted units in the <br /> project are suitable for occupancy. HOME assisted units must be inspected every two <br /> years by the City. <br /> 23.NON-DISCRIMINATION. Owner shall not discriminate against prospective tenants <br /> based on receipt of, or eligibility for, housing assistance under any Federal, State, or <br /> local housing assistance program. Owner shall not discriminate against prospective <br /> tenants with whom a minor child or minor children will reside. <br /> 24.NO RELIGIOUS PURPOSES. Owner shall not use any funds provided under this <br /> Agreement for religious activities, to promote religious interests, or for the benefit of a <br /> religious organization in accordance with the federal regulations specified in 24 CFR <br /> 9 2.5 04 (c)(3)(x). <br /> 25.AFFIRMATIVE MARKETING PRACTICES. Owner shall exercise affirmative marketing <br /> practices to locate and recruit prospective tenants, including, but not limited to, use of <br /> commercial media, community contacts, and signage. Affirmative marketing is to <br /> promote fair housing to ensure outreach to attract eligible persons to available housing <br /> without regard to race, color, national origin, sex, religion, familial status, or disability. <br /> Affirmative marketing requirements apply to projects which target persons with special <br /> needs. Owner shall provide annual documentation of efforts to advertise and solicit for <br /> applications, including affirmative marketing. <br /> 26.EQUAL OPPORTUNITY. Owner shall display the "Equal Opportunity" logo or sign in <br /> every advertisement-soliciting tenants. Owner must maintain a written tenant <br /> selection plan,and follow such tenant selection plan.The lease must be at least one year <br /> in length. The "Lease" cannot contain prohibitive provisions (see 24 CFR 92.253). <br /> Termination of tenancy or refusal to renew leases shall be preceded by 30-day notice <br /> specifying the grounds for such action. <br /> 27.SPECIAL OUTREACH PROVISIONS. Owner shall inform, and solicit applications from, <br /> persons in the housing market area who are not likely to apply for housing without <br /> special outreach, including community organizations, churches, employment centers, <br /> fair housing groups, and housing counseling agencies. Owner acknowledges that under <br /> 24 CFR 92.351(a) (1), affirmative marketing procedures do not apply to families with <br /> Section 8 tenant-based rental housing assistance. <br /> 28.RENTAL REQUIREMENTS. Owner shall comply with such guidelines for establishing <br /> and requiring monthly rental payments as shall be from time to time identified and <br /> required by City as required under 24 CFR Part 92.
