performance of any and all work under this Agreement. Upon request, Heritage shall furnish <br /> copies of said insurance policies and all accompanying endorsements to the City. The <br /> certificates of insurance shall include the City of Decatur,Illinois, its officers, directors, and <br /> employees as additional insureds. In no event shall any failure by the City to receive certificates <br /> or to demand receipt be construed as a waiver of the obligation to require, obtain, and keep in <br /> force the required insurance. <br /> 23. Heritage, its contractors and sub-contractors agree to indemnify and hold harmless <br /> the City, and its officers, directors and employees from and against all liability, claims, demands <br /> and expenses, including court costs and attorney fees, on account of any injury, loss or damage <br /> which arise out of or are in any manner connected with the work to be performed under this <br /> Agreement, if such injury, loss or damage is caused in whole or in part by, or is claimed to be <br /> caused in whole or in part by the negligent acts, errors or omissions of Heritage, its contractors <br /> or sub-contractors of the contractor, or any officer, employee or agent of Heritage, its contractors <br /> or sub-contractors. The obligations of this Section shall not apply to damages which the City <br /> shall become liable by final judgment to pay to a third party as the result of the negligent act, <br /> error or omission of the City, its officers, directors, employees, or agents of the City. <br /> 24. For those permits issued by the City of Decatur for the Project,permit fees will be <br /> waived. <br /> 25. Heritage shall contract and use only those contractors that are licensed and bonded <br /> to work in City rights of way. <br /> 26. Heritage shall ensure that access is provided to the employees or agents or the Public <br /> Works Department to inspect materials and construction workmanship as needed and determined <br /> by the City. <br /> 27.
