Exhibit A <br /> City of Decatur <br /> South Taylorville Road Watermain Replacement Project <br /> Scope/Fee/Agreement Assumptions <br /> 1. This Agreement and any legal actions concerning its validity, interpretation, and performance <br /> shall be governed by the laws of the State of Illinois. <br /> 2. Local permits for this project will be obtained by the City with information provided by Clark <br /> Dietz.All permit fees will be paid by the City. <br /> 3. State permits for this project will be obtained by the City with information provided by Clark <br /> Dietz. All permit fees will be paid by the City. <br /> 4. This Agreement does not include obtaining or processing Federal permits. <br /> 5. The areas will be designed, bid, and constructed as one project. Up to 2 Additive Alternates will <br /> be prepared. <br /> 6. The base bid improvements include proposed water main installation, with utility trenches <br /> restored using concrete pavement patches. Complete pavement reconstruction, including curb <br /> &gutter and driveway pavement removal and replacement, is not included. Curb &gutter and <br /> driveway pavement may be removed and replaced as necessary at spot locations. <br /> 7. This Agreement includes negotiation or acquisition services that may be required to obtain up to <br /> 25 right-of-way,temporary easements, or permanent easements. <br /> 8. This Agreement does not include field staking for right-of-way or easements. Clark Dietz does <br /> not perform construction staking. <br /> 9. This Agreement does not include the preparation of assessment roles or schedules. <br /> 10. This Agreement does not include contaminated site Phase I or Phase II environmental <br /> assessment investigations or remediation activities. <br /> 11. This Agreement does not include special waste assessment investigations, Preliminary <br /> Environmental Site Assessments, Preliminary Site Investigations, or special waste remediation <br /> activities. <br /> 12. This Agreement includes obtaining environmental clearances from IDNR through EcoCAT and <br /> SHPO review.This Agreement does not include biological,wetland, cultural, historic, or <br /> archeological investigation and/or remediation activities. <br /> 13. This Agreement assumes that funding is being obtained from local funds, therefore a Facility <br /> Plan, environmental clearances, and loan applications are not required. <br /> A-2 <br />
