the benefit of the City. Copies of any of these warranties shall be <br /> provided to the City. <br /> v. The City will not be responsible for the storage of any equipment <br /> associated with the project. <br /> vi. The vendor shall remedy,at its own expense, damage caused by the <br /> vendor to City-owned or controlled real or personal property. <br /> vii. The vendor shall be liable to the City for supply of information,materials, <br /> and labor necessary for mandatory revisions determined by the <br /> manufacturer for the duration of the warranty period at no cost to the City. <br /> viii. The acceptance of systems/equipment by the City shall not limit the City's <br /> warranty rights set forth above with respect to defects in materials or <br /> workmanship. <br /> d. Warranties on Additional Equipment <br /> Warranty on any additional system components purchased after acceptance of the <br /> initial system will be for not less than 12 months after the date the hardware or <br /> software is accepted and placed in service. <br /> e. Maintenance during the Warranty Period <br /> Proposals shall describe how maintenance and repair will be handled during the <br /> warranty period. During the warranty period,the vendor will respond to all <br /> service calls at no additional cost to the City. Service calls shall be responded to <br /> 24 hours a day, seven days a week, since the network will support vital City <br /> operations (not just during normal business hours). The amount of time required <br /> for the vendor to respond shall be within two hours (remote access is acceptable <br /> for initial response). Vendor response may be in the form of a call-back from a <br /> qualified technician,or remote support.The vendor will have qualified <br /> technicians available to respond to major system malfunctions within four hours <br /> and for minor system malfunctions within two business days during the warranty <br /> period. The City reserves the right to decide whether a system malfunction is <br /> classified as major or minor. <br /> Acceptance of the work of the vendor,upon completion of the project, shall not preclude <br /> the City from requiring strict compliance with the contract,in that the vendor shall <br /> complete or correct upon discovery any faulty, incomplete,or incorrect work not <br /> discovered at the time of acceptance. The one-year limit specified above shall not void or <br /> limit this requirement for little used features or functions. <br /> 6. General Information and Additional Requirements <br /> a. Freedom of Information Act-Effective January 1,2010: All documents and <br /> records in the possession of contractors, sub-contractors,and any other person <br /> employed by the contractor or sub-contractor to perform a governmental function <br /> on the City's behalf and directly related to the governmental function are subject <br />
