Exhibit A <br /> City of Decatur <br /> North Summit Avenue Drainage Improvements Project <br /> Scope/Fee/Agreement Assumptions <br /> 1. This Agreement and any legal actions concerning its validity, interpretation,and performance <br /> shall be governed by the laws of the State of Illinois. <br /> 2. Local permits for this project will be obtained by the City with information provided by Clark <br /> Dietz, Inc.All permit fees will be paid by the City. <br /> 3. State permits for this project will be obtained by the City with information provided by Clark <br /> Dietz, Inc. All permit fees will be paid by the City. <br /> 4. This Agreement does not include obtaining or processing Federal permits. <br /> 5. This Agreement does not include field staking for right-of-way or easements. Clark Dietz, Inc. <br /> does not perform construction staking. <br /> 6. This Agreement does not include the preparation of assessment roles or schedules. <br /> 7. This Agreement includes negotiation or acquisition services that may be required to obtain up to <br /> 25 right-of-way, temporary easements, or permanent easements. <br /> 8. This Agreement does not include contaminated site Phase I or Phase II environmental assessment <br /> investigations or remediation activities. <br /> 9. This Agreement does not include special waste assessment investigations,Preliminary <br /> Environmental Site Assessments, Preliminary Site Investigations, or special waste remediation <br /> activities. <br /> 10. This Agreement includes obtaining environmental clearances from IDNR through EcoCAT and <br /> SHPO review. This Agreement does not include biological, wetland,cultural,historic,or <br /> archeological investigation and/or remediation activities. <br /> 11. This Agreement assumes that funding is not being obtained from the IEPA SRF program for the <br /> project and therefore a Facility Plan, environmental clearances, and loan applications are not <br /> required. Funding assistance in any form is not included in the scope of services. <br /> 12. This Agreement includes no time for archaeological survey that may be required during Tribal <br /> consultation as no Tribal consultation is assumed necessary. If it is deemed necessary,that work <br /> will be covered under a different agreement with the City. <br /> 13. This Agreement does not include a Geotechnical survey. If those services are required,the City <br /> will provide that information as part of a separate agreement. <br /> 14. This Agreement does not include televising for sewer service laterals or design for sewer lining. <br /> A-2 <br />
