h <br /> AGREEMENT BETWEEN CITY OF DECATUR, ILLINOIS <br /> AND <br /> OAKLEY TOWNSHIP, ILLINOIS ROAD COMMISSIONER <br /> WHEREAS, the City of Decatur, Illinois ("City") has contracted to dredge certain k <br /> portions of Lake Decatur; and, <br /> WHEREAS, the City requires an area for storage of sediment generated from its <br /> dredging activities; and, <br /> i <br /> WHEREAS, there is located in Oakley Township ("Oakley") property that the City <br /> has used previously-for-the deposit of sediment from.prior dredging activities.commonly <br /> referred-to as the Oakley Township Sediment Storage-.Basin ("Basin"); and, <br /> WHEREAS, the City is desirous to continue to use the .Basin for its future <br /> dredging activities and Oakley is willing -to permit :such .use, and has approved such <br /> -pending the parties' agreeing-to a Road Use Agreement ("Agreement") with-the Oakley <br /> Township Road Commissioner ("Commissioner"). <br /> -NOW THEREFORE, the City and Commissioner do hereby.agree .and :stipulate <br /> -to the-following: <br /> A. -SPECIAL USE PERMIT. <br /> 1. The Commissioner agrees to allow the use of -the roadways described <br /> below.by the City in-the use of its dredge project and to act in a reasonable manner to <br /> facilitate such use. <br /> 2. The Parties agree-that the Stipulations -for City of Decatur .Special Use <br /> i <br /> Permit adopted by the Macon County Board on January 9, .2014 shall:be .adopted and <br /> incorporated into this Agreement. Said Stipulations are attached hereto marked Exhibit <br /> 1 and incorporated by reference. <br /> B. ENTRANCE.CONSTRUCTION AND ROAD IMPROVEMENT. <br /> 1. The City shall construct a new vehicular entrance to the.Basin. kk� <br /> 2. The City agrees -the above-referenced entrance shall be located on the I! <br /> north side of the property and in alignment with Stare Road to the north and will allow f <br /> heavy construction equipment and contractor vehicles to enter directly into the facility <br /> from Angle Crossing Road. <br /> I <br /> 3. The City agrees that Angle Crossing Road will be used by heavy equipment <br /> operators and contractors to access the Basin. j <br /> I <br />
