-2 - <br /> D. USE OF LEASED PREMISES <br /> 1. Library acknowledges that City will use the Leased Premises for storage of <br /> documents. <br /> 2. City will, at City's expenses, fence the Leased Premises with the fencing of a <br /> construction and appearance that will not be adverse to the Library's ability to lease the <br /> remaining area on the upper floor. <br /> 3. Upon vacation of the Leased Premises, the City shall have the right to remove and <br /> take any improvements made to the Leased Premises but shall restore the Leased Premises to <br /> their original condition, ordinary wear and tear excepted. <br /> 4.. Library agrees to keep and maintain the Leased Premises in such condition as <br /> necessary for the City to be able to store and retrieve documents, except that if more than <br /> ordinary and customary means are required to access and retrieve documents, any resulting <br /> expense shall be borne by the City. <br /> E. AS IS CONDITION <br /> 1. City accepts the Leased Premises in an"As Is"condition. <br /> 2. Library shall be responsible for the utility charges for the Leased Premises, with <br /> the City to be responsible for any increase in those charges occasioned by the City's use of the <br /> Leased Premises. <br /> F. LIABILITY <br /> 1. Library shall take all steps reasonably necessary to protect the integrity and <br /> security of the Leased Premises. <br /> 2. Unless due to Library's negligence, Library shall not be liable for any loss or <br /> damage to property stored in the Leased Premises. <br />
