CONTRACT <br /> operations and the cost for labor, equipment and materials will be deducted from the <br /> contract. <br /> SECTION 25. Royalties, Patents And Copyrights <br /> The Contractor shall pay all royalties and license fees. The Contractor shall defend suits or <br /> claims for infringement of copyrights and patent rights and shall hold the City, its agents, <br /> officers and employees harmless from loss on account thereof, but shall not be responsible <br /> for such defense or loss when a particular design, process or product of a particular <br /> manufacturer or manufacturers is required by the Contract Documents or where the <br /> copyright violations are contained in Drawings, Specifications or other documents <br /> prepared by the Architect. However, if the Contractor has reason to believe that the <br /> required design, process or product is an infringement of a copyright or a patent, the <br /> Contractor shall be responsible for such loss unless such information is promptly furnished <br /> to the Architect. <br /> SECTION 26. Safety <br /> The Contractor shall be responsible for the safety of all persons on the work, and shall <br /> exercise all necessary precautions and furnish necessary material to provide for the safety <br /> and protection of all persons on the work. The Contractor shall comply with the safety <br /> provisions of applicable building codes, Municipal, County, State and Federal, and <br /> provisions of the Occupational Safety and Health Act of 1970, and the standards <br /> established thereunder. <br /> The Contractor is solely responsible for any and all procedures, methods, structures or <br /> equipment submitted or employed. The acceptance thereof shall not in any manner relieve <br /> the Contractor of any liability whatsoever on account of any procedures or methods <br /> employed by them, or due to any failure or movement of any structures or equipment <br /> furnished by them. <br /> SECTION 27. Schedule Notification <br /> It shall be the responsibility of the Contractor to notify the Engineering Division of the <br /> City, in writing, of the schedule of street closures for the following week. The Engineering <br /> Division will notify the local media and return a copy of the media release to the <br /> Contractor. <br /> This work shall be considered as incidental to the contract and no additional compensation <br /> will be allowed. <br /> SECTION 28. Trench And Excavation Safety <br /> The Contractor will comply with all Federal, State and City laws, regulations and <br /> procedures governing trench and excavation safety. In no case will trench/excavation <br /> protection be less than the standards and regulations established by the "Department of <br /> Labor, Occupational Safety and Health Administration 29 CFR Part 1926, Occupational <br /> Safety and Health Standards - Excavations; Final Rule." <br /> 8 <br />
