City Plan Commission
August 2,2012
Page 3
Mr. McDonald stated Tract B will have a green zone of 1,300 feet and Tract A will have a 1,250
foot green zone. With the exception of the Pugh home, nothing at either tract will be visible to the
residents. There is a significant amount of trees around the area.
Mr. McDonald said there was an issue with the egress from Faries Park Road which is owned by
ADM. The Beck compound will have access to the road. There are no plans in the future to close
the road and the residents have been promised if the road was ever closed in the future they would
be given an alternate egress to the north. ADM has also agreed to maintain a five hundered foot
green space around their properties.
Mr. McDonald stated this project is a $200 million project which will help the local economy.
There will be hundreds of area businesses that will be connected to the project as well as the local
merchants not directly connected with the project that will also benefit.
Chairman Livingston asked Mr. McDonald to discuss the items that were problems for the residents
and what resolution they came to. Mr. McDonald said there were three (3) issues. The first issue is
adequate green space so that any development would not be visible or impact their view. They
walked the area and five hundred feet seemed to be suitable for most everyone. The northbound
egress is the second issue. An agreement was reached on this issue with ADM promising they
would leave the road open for the residents and if in the future ADM were to close it they would
provide them with an alternate northbound egress. The third issue is related to property values and
buyout provisions. Mr. McDonald said he fully understands the residents wanting their property
values guaranteed if in the future there would be further development which would negatively
impact their property values, however; we all make choices and the residents are next door to a
water treatment plant. Things do change and their residences are close to industry. ADM will not
construct facilities on the lake as it is not suitable for construction so there would be no reason for
ADM to purchase their properties. Mr. McDonald thinks the ADM project will lead to a lot of
development in our community and will bring a lot of good things for everyone.
Mr. Jack Myatt asked if this project was federally funded. Mr. McDonald said $140 million is
being received from the Federal government.
Mr. Myatt asked if the five hundred feet of green space was from the resident's property line. Mr.
McDonald said yes.
Mr. Myatt asked if the allowances ADM is making for the residents was in writing or just done by a
handshake. Mr. McDonald said a letter was sent prior to meeting the residents but it did not specify
the exact footage of the green space. The northbound egress is specifically mentioned in the letter
from Jim Shafter. If an agreement had been made it would have been able to be put in writing.
Mr. Rick Heavner said the green space is no longer an issue. The closest rezoning to the property
will be 1,250 feet. No guarantee for green space is needed. The property is not being rezoned as in
the first petition. As to the road issue, ADM has no intention to block off the road; if for some
reason the southern part of the road would be blocked off ADM will make an access north for the
residents. The road has nothing to do with the rezoning petition.
Mr. Heavner said when the Park District proposed trading ADM for Faries Park for their property in
the south, which was developed into Red Tail Run golf course, a public referendum was held and
passed with the express propose of the Park District developing the golf course and ADM using the
land for future development. The referendum passed with over a vote of seventy percent. Mr.
Heavner said this will be a little substation in the western portion of Tract B and it will not be able
to be seen two hundred feet away. It is not noisy and will have no affect on the properties 1,300
feet away.
